The fire at a Fall River nursing home this month that killed ten people started in a second floor resident's room.
Officials say numerous smoking materials were found in the room at the Gabriel House where the fire started, along with an oxygen tank.
Bristol District Attorney Thomas Quinn says the fire was likely accidental, but the exact cause may never be known.
The person who lived in the second floor room where the fire started is one of the ten residents who died.
Meantime a survivor of the Gabriel House assisted living facility fire in Fall River has filed a lawsuit against the operator.
Ten residents were killed and around 30 people were injured in the fire on July 13th. Plaintiff Steven Oldrid's lawsuit accuses Gabriel Care Incorporated of negligence.
Oldrid alleges that the home was not properly staffed or managed and that the facility was not maintained effectively.
The suit also alleges that the home's evacuation plans failed, and that bans on smoking at the facility were not enforced.
