SCOTUS Declines MA Student Dress Code Case

The Supreme Court is declining to hear a Massachusetts student's dispute with his school over its ban on a T-shirt.

The case stems from a Middleborough middle school student who was prohibited from wearing a T-shirt bearing the slogan "there are only two genders."

Two conservative members of the court, Justice Clarence Thomas and Justice Samuel Alito, dissented from the decision not to hear the case.

The student's lawyers say the dress code's restrictions on speech are unconstitutional while a federal district court judge and the Boston-based 1st U.S. Circuit Court of Appeals ruled in favor of the school.
